Terms of Use

Who we are

Yo!Dara Publishing (“Yo!Dara,” “we,” “us,” or “our”) is a publishing company in the Hikari Create network. References to Hikari Create do not make this Site a substitute for Hikari Create’s separate services or terms.

Permitted use

You may use the Site only for lawful purposes. You may not interfere with its operation; attempt unauthorized access; upload malicious code; scrape or overload the Site; impersonate another person; submit unlawful, infringing, fraudulent, threatening, or abusive material; or use Site content commercially without permission.

Our content

The Site, Yo!Dara name and branding, Dara characters, GRIN and 99 Must Die materials, interface, copy, graphics, and other publisher-provided content are owned by Yo!Dara or used with permission and are protected by intellectual-property laws. No rights are granted except the limited right to view and use the Site under these Terms.

Your submissions and ownership

You retain ownership of creative work you submit. By submitting, you grant Yo!Dara a limited, nonexclusive, royalty-free permission to receive, store, reproduce internally, back up, and share the material with authorized personnel and service providers solely to operate the submission system, evaluate the work, communicate with you, and consider a possible business relationship. This review permission ends when it is no longer reasonably needed, subject to backup, legal, security, and recordkeeping requirements.

You represent that you own or control the submitted material, have permission from all necessary collaborators, and have disclosed any prior publication, license, exclusivity, or other restriction. Do not submit work you are not authorized to share.

No promise of confidentiality or publication

We use reasonable access controls for submissions, but submitting does not create a nondisclosure, fiduciary, agency, employment, partnership, or publishing relationship. Yo!Dara may already be developing or may later receive material with themes, premises, characters, or elements similar to yours. Submission does not guarantee feedback, response, acceptance, development, compensation, or publication. Any rights acquisition or publishing relationship requires a separate written agreement signed by the parties.

Creator communications

You authorize us to contact you about your submission using the email address provided. If you join The Next Chapter list, you may unsubscribe from marketing communications. Transactional or submission-related messages are separate from marketing.

Accounts and staff areas

If you receive access credentials, you are responsible for keeping them confidential and for activity under your account. Staff areas, unpublished work, creator information, and internal notes are restricted. We may suspend access to protect the Site or enforce these Terms.

Third-party services and links

The Site may rely on hosting, email, security, or other providers and may link to websites such as Hikari Create. We are not responsible for third-party content, availability, or practices.

Availability and disclaimers

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. We do not promise uninterrupted, secure, or error-free operation or any particular editorial result.

Limitation of liability

To the fullest extent permitted by law, Yo!Dara and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, lost profits, lost opportunities, or loss of data arising from the Site. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

Indemnification

To the extent permitted by law, you agree to defend and indemnify Yo!Dara and its affiliates against claims, losses, and reasonable costs arising from your unlawful use of the Site, your breach of these Terms, or material you submit that violates another party’s rights.

Termination and changes

We may restrict or terminate access when reasonably necessary for security, legal compliance, or enforcement. We may revise these Terms by posting an updated version and date. Continued use after a revision means you accept the revised Terms.

Applicable law

These Terms are governed by applicable law in the jurisdiction where Yo!Dara is organized, without regard to conflict-of-law principles. Nothing in these Terms limits rights that cannot legally be waived.
